Silencio’s Deep-In Luck Raffle for App Users – Terms and Conditions

These Terms and Conditions (“Terms”) govern participation in the Deep-In Luck Raffle (“Raffle”) organized by Silencio Network LLC, the Blocksound Foundation, Blocksound TokenCo (BVI) Ltd., any other Silencio Network Ecosystem Affiliate and Third-Party providers. By participating in the Raffle, you agree to these Terms in full, as well as Silencio's General Terms & Conditions and Privacy Policy

1. Overview of the Deep-In Luck Raffle

The Deep-In Luck Raffle is a free, automatic and optional promotional event designed to engage, grow, and reward the Silencio community only. Participation is open to eligible Silencio App users, entirely voluntary, and no purchase, value delivery or payment is required to enter.

  1. Purpose: The Raffle rewards active participants of the Silencio ecosystem through a randomized blockchain-based selection process.

  2. Prize Pool: Over 100 million unique prizes valued at 500 million $SLC tokens are distributed monthly. Each month, the Blocksound Foundation and Blocksound TokenCo (BVI) Ltd. allocate 541,666,666.67 $SLC tokens from the community reserve. These prizes are not part of the Referral Programme and are not subject to the Referral conditions between users.

  3. Additional Third-Party Prizes: Besides $SLC token rewards, participants may win third-party products, hardware devices, software, coupons, or high-value prizes (such as computers, phones, vehicles). These prizes are not part of the Referral Programme and are not subject to the Referral conditions between users.

  4. Transparency: All results are publicly verifiable via blockchain and will be available on Silencio’s or the Blocksound Foundation’s website and social media after each draw.

  5. No Obligation: Silencio is under no obligation to conduct the Raffle monthly and reserves the right to cancel, postpone, or modify the Raffle and its rules at its sole discretion.

2. Eligibility

The Silencio Users and Raffle Participants must meet the following eligibility requirements to participate and claim the prizes:

  1. Age Requirement: Participants must be at least 18 years old and meet the legal age requirement in their country of residence. Successful KYC verification is required before prize distribution.

  2. Residency: The participation is open to legal residents of jurisdictions where such participation is not prohibited by law.

  3. Restricted Countries: Participants residing or claiming prizes in jurisdictions where crypto-related rewards, blockchain raffles, raffles in general or specific prizes are restricted may not be eligible. Silencio reserves the right to deny entry based on jurisdictional laws. Therefore, we advise users who reside in an eligible country but are visiting a prohibited country to ONLY participate and claim while physically present in their eligible country of residence.

  4. Exclusions: Employees, officers, and directors of Silencio Network LLC, the Blocksound Foundation, BlockSound TokenCo (BVI) Ltd. their affiliates, and immediate family members are not eligible for any Physical Prizes or high value prizes.

  5. Compliance: Participants are responsible for ensuring their participation complies with all applicable local, state, federal, and international laws and regulations.

3. Participation

Please consider the following additional rules of participation:

  1. Entry Requirements for the Silencio App:

    1. Participation is only available to Silencio App users with Raffle Tickets, is free and automatic and claiming the prizes is optional.

    2. Participants must collect Raffle Tickets by earning In-App Coins through activities such as measuring noise levels or inviting friends.

    3. Each In-App Coin earned in one single month equals one Raffle Ticket for that month’s Raffle. The In-App Coins are never exchanged for Raffle Tickets but merely reflect the effort made by the user, and therefore mirror the number of Raffle Tickets earned for the Raffle.

    4. Boosting Odds: The more tickets a participant collects, the greater their chances of winning higher-value prizes. Additionally, the Referral Program and the OG Program (more explained in the Whitepaper) allow users to further enhance their winning potential by earning extra raffle tickets for each successful referral. The prizes themselves are not part of the Referral Programme and are not subject to the Referral conditions between users.

    5. No Purchase, Exchange or Trade of In-App Coins: In App Coins cannot be purchased but only earned by actively participating in the Silencio App experience. Users cannot exchange In-App Coins or sell them openly. Other than for the App features and Raffle participation, the In-App coins do not have any monetary value whatsoever and should never be used as a medium of exchange.

4. Prizes and Third-Party Products

  1. Prize Categories:

    1. Range from ‘Iron Nuggets’ (1 $SLC) to ‘Diamonds’ (11+ million $SLC).

    2. Additional Physical Prizes: Additional prizes may include third-party products, blockchain hardware, software, coupons, or luxury items (e.g., vehicles, computer hardware, etc.). The inclusion of such prizes is entirely at Silencio’s sole discretion and does not guarantee their availability in future raffles.

  2. Full Authority. 

Silencio retains full authority to determine:

  1. Whether to include additional prizes;

  2. The total purchase value of a prize, and where to get the information for the total purchase value;

  3. The purchase location and currency used;

  1. No winner or any participant has influence over the prize category, additional features, delivery options or any other specifications. If a specific prize is mentioned but is unavailable or unfeasible at the time of awarding, Silencio, the Blocksound Foundation, Blocksound TokenCo or third-party prize provider reserve the right to provide a similar or cash alternative or provide the prize at a later date when it is available.

  2. Silencio may substitute a prize if sudden price fluctuations or supply constraints arise. High tariffs or taxes associated with delivery are not included in the total prize value and remain the responsibility of the recipient. Any future maintenance, renewal or in general any costs of the prizes received are similarly not included in the prize.

5. Additional Restrictions:

  1. Some prizes cannot be shipped to certain locations due to legal, regulatory, or logistical constraints.

  2. If delivery is not possible, Silencio reserves the right to cancel the prize or offer an alternative. High tariffs or taxes for the delivery are not included in the total value of the prize should an alternative be offered to the winner. Silencio will offer alternatives at face value of the prize at hand. 

  3. Prizes requiring specific age, licensing, or legal compliance (such as vehicles) may be denied, without the obligation to provide an alternative, if the winner does not meet these requirements.

  4. Non-Transferable: Prizes cannot be transferred, exchanged, or sold. No cash alternatives are provided unless specifically accepted by Silencio.

  5. Claim Period: SLC Prizes must be claimed within 21 days of notification while Physical Prizes must be claimed within 15 days of notification. Failure to claim results in forfeiture.

6. Winner Selection and Notification

  1. Selection Process: Winners are chosen randomly via a blockchain-verified algorithm.

  2. Notification: Winners will be notified via the app and the contact details provided.

  3. Forfeiture: If a winner does not claim their prize within the specified Claim Period, it will be forfeited and the user will lose his/her right to claim the prize.

7. Fraud Prevention & Multi-Account Restrictions

  1. One Account Per Person: Each participant must use only one verified account.

  2. No Automation or Manipulation: Using bots, scripts, or artificial engagement to gain unfair advantages is strictly prohibited.

  3. Silencio reserves the right to disqualify or suspend users engaging in fraudulent activities from any Raffle participation or earnings.

8. Release of Liability for Third-Party Prizes

  1. Release of Third-Party Responsibilities:

    1. Silencio is not responsible for defects, warranties, delivery issues (i.e. custom controls), tariffs, or functionality issues related to third-party prizes.

    2. Any complaints, disputes, or claims regarding third-party products must be directed to the respective supplier, business or manufacturer.

9. Dispute Resolution

  1. Amicable Resolution First: Participants must attempt to resolve disputes by contacting support@silencio.network.

  2. Binding Arbitration:

    1. If the dispute remains unresolved, it shall be settled through binding arbitration under AAA (American Arbitration Association) rules.

    2. Arbitration will occur in Delaware, USA, and the arbitrator’s decision is final.

  3. Class Action Waiver: Participants waive their right to participate in any class-action lawsuit against Silencio, the Blocksound Foundation or the Blocksound TokenCo (BVI) Ltd..

  4. Governing Law & Jurisdiction: These Terms are governed by Delaware, USA law, and any disputes shall be settled in Delaware courts, except for arbitration matters.

10. Integration with Silencio’s General Terms & Privacy Policy

  1. General Terms Apply: Participation in the Raffle is also subject to Silencio’s General Terms & Conditions, available at www.silencio.network/termsandconditions.

  2. Privacy Policy: By participating, users agree to Silencio’s Privacy Policy, which governs data collection and usage. Available at www.silencio.network/privacy-policy.

11. Force Majeure & Liability Limitations

  1. Uncontrollable Events: Silencio is not liable for delays or cancellations caused by force majeure events, including natural disasters, death, regulatory changes, cyberattacks, or technical failures.

  2. No Guaranteed Value: $SLC token rewards are subject to market volatility, and Silencio does not guarantee any specific fiat or cryptocurrency value.
